On March 13th, the President instructed the Department of Labor “to propose revisions to modernize and streamline” existing Fair Labor Standards Act regulations. Although it is difficult to predict what the revisions will be, the Administration appears to be focused on three key areas: (1) raising the minimum salary level above its current level of $455/week for employees to qualify for exempt status; (2) revising the duties requirement for the executive exemption; and (3) revising the definition of a computer professional. We have received a number of inquiries from clients about the potential impact of this development on their workplaces.
