Jenny Smith’s practice focuses on employee benefits law, including all aspects of ERISA. She has extensive experience with retirement plan compliance (401(k) plans, 403(b) plans, defined benefit plans, etc.) and providing legal advice to retirement plan vendors.
Jenny regularly represents plan sponsors before the Internal Revenue Service and the Department of Labor in connection with voluntary correction programs and plan audits. She advises clients regarding employee benefit issues such as plan administration, fiduciary liability, controlled group/affiliated service group determinations, and Qualified Domestic Relations Orders (“QDROs”).
Jenny also focuses on plan documents and administrative procedures for cafeteria plans and welfare benefit programs. This work includes providing guidance regarding employer mandate compliance and required reporting under the Patient Protection and Affordable Care Act. In addition, Jenny assists with labor and employment law compliance, providing counsel relating to human resource practices.
